This Privacy Police explains how we use any personal data we collect about you and your rights in relation to the information. “Personal data” means any information that identifies you as an individual or is capable of identifying you as an individual. For the purpose of applicable data protection laws, including the General Data Protection Regulation (the “GDPR”), the data controller is Gains For Gamers with email address info@gainsforgamers.com.
CANCELLATION & REFUND POLICY
We strongly believe in and stand behind our products 100%, but we understand that it might not work perfectly for everyone all of the time. If you are unhappy with your purchase, or you have an issue that we are unable to resolve, we will be happy to offer you a refund.
Refunds will be offered at our sole discretion and must meet all of the following conditions fully:
- You are within the first 30 days of the initial purchase of your subscription.
- If you have made a purchase, requested a refund for that item, and then purchased again we will not issue the refund the second time.
- We will need your full name, email, and invoice ID from your purchase to grant your refund (if you are a member of our Discord server, we will need your gamer tag too)
- If you wish to get a refund, you will have to contact us here: info@gainsforgamers.com or open a ticket in our Discord (this requires you to have the Inner Circle role).
- We do not offer any refunds on any customized items, such as the Dynamic Meal Plan which can be purchased at check-out. If you purchase customized items, you will still have the full 30 days refund on your Inner Circle subscription.
- Due to the digital nature of pre-made items such as The Mythic Nutrition Vault and other PDF materials, we cannot accept returns or offer refunds. Once these products are purchased, they are considered permanently acquired by the customer, as there is no way for us to retrieve the digital content.
- Our 30-days refund guarantee on your Inner Circle subscription is only available, if you sign up through our website, here: https://gainsforgamers.com. We can't offer this guarantee, if the purchase was made through App Store or Google Play.
- Any subscriptions bought with a higher percentage discount than 31% - or free trials - does not have any refund guarantees.
- Subscriptions purchased through the website can only be canceled via. email or in the Discord server via. a ticket. The subscription will not show up in the app as active (only if purchased through Google Play or App Store). One-on-one fitness coaching policies:
- There are no refunds on any customized items, this includes our one-on-one coaching.
- Subscriptions for our personalized one-to-one coaching persist until the client intentionally opts to terminate. Such termination can be effectuated by dispatching an email to: info@gainsforgamers.com.
- The option to discontinue one-to-one coaching subscriptions becomes available only after the completion of the initial subscription package term for which the client has enrolled. For instance, if a client subscribes for a four-month term, the subscription can only be terminated upon the conclusion of these four months. Should the client desire termination on the last day of the subscription, they would need to send us an email during the active subscription period, for example, in the third month.
PURPOSE AND LEGAL BASIS FOR PROCESSING YOUR PERSONAL DATA
We use the personal data we collect from and about you for the following purposes:
- to set up and manage your online account.
- to provide our services to you
- to provide you with information about our products and services (provided you have either consented to this or we by other means are allowed to reach out to you for marketing purposes).
- to process your payments, keep internal records and manage our relationship with you.
- to notify you of any changes to our services that may affect you.
- to charge you depending on the subscription plan you select. We reserve the right to charge your account on a recurring basis at intervals of one month, three months, six months, nine months, or annually, in accordance with the specific terms of your chosen plan.
The legal bases for which we collect, use, transfer or disclose your personal data include:
- the performance of our contract obligations with you (see article 6(1)(b) of the GDPR).
- our legitimate interests (see article 6(1)(f) of the GDPR), which include: improving our offerings as a business; personalizing our services and interactions with you, to better meet your needs as a customer; and detecting and preventing fraud.
- compliance with our legal obligations.
- to the extent we send you information on our products and services for marketing purposes, we will either ask for your consent (in accordance with article 6(1)(a) of the GDPR) before processing your information in this way or process your personal data based on our legitimate interests (in accordance with article 6(1)(f) of the GDPR – the legitimate interests are stated above).
Pictures that you choose to share with Gains For Gamers are used by us solely for tracking your progress and will never be shared on our website or social media unless you give your explicit consent hereto.
In order for us to be able to deliver customized meal- and workout plans to you, we may process certain health data provided by you, including information on allergens, information that might reveal obesity or specific injuries or other relevant information related to your physical or mental health status.
The legal basis for our processing of your health information is Article 9 (2) a) cf. Article 6 (1) b) of the GDPR, which means that we will ask you for your explicit consent to allow us to process your health data prior to you becoming a client with us.
You may at any time withdraw your consent to us processing your health data. However, you should be aware that if we are prevented from processing relevant personal data, including information on any allergens, information that might reveal obesity or specific injuries or other relevant information related to your physical or mental health status, we will not be able to provide you with our services (customized meal- and workout plans based on your unique needs).
80% Engagement Refund Guarantee
Occasionally, we offer a Result Guarantee for our 1-on-1 coaching clients. This guarantee applies under the following conditions:
- Follow the Program: Actively participate in workouts and follow our program guidelines. This means actively tracking the workouts in the app so the coach can follow along.
- Weekly Check-Ins: Complete regular weekly check-ins to monitor progress.
- Maintain an 80% Engagement Rate: Ensure at least 80% participation in all program activities, workouts and check-ins from the start to the end of the subscription.
- Achieve Results: If clients meet these criteria but do not see their desired results, they are eligible for a refund.
This guarantee is subject to specific terms and is only available as part of select offers.
CATEGORIES OF PERSONAL INFORMATION
This Privacy police covers all personal data collected and used by us.
This includes your: name, age, postal address, email address, phone number, credit card number, information on your body and wellbeing including height, weight (including information on obesity), body statistics, workouts, mood, meals, nutrition and general health and wellbeing, that you decide to disclose to us on this website or through the use of our app, as well as any pictures that you choose to share with us.
THIRD PARTIES, INCLUDING PROCESSING BY BENEFIT TECHNOLOGIES APS (BeeFit)

Our service providers who help us to provide our services to you, such as our infrastructure and IT service providers. These include BeneFit Technologies ApS – better known as the software we use: “BeeFit”.
Our payment platform that handles transactions so that you can buy our products.
Our website may, from time to time, contain links to and from the websites of our partners, or affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy notices and that we have no control over how they may use your personal data.
TIME LIMITS FOR KEEPING PERSONAL DATA
Your personal data will only be stored for as long as necessary for the purposes for which they were collected.
When we no longer need to use your information, we will remove it from our systems and records and / or take steps to promptly anonymise it so that you can no longer be identified from it (unless we need to keep your information to comply with legal or regulatory obligations to which we are subject).
As a general rule, we erase or anonymise your personal data 12 (twelve) months after your last activity.
